Pierre Duhem's often unrecognized influence on twentieth-century philosophy of science is illustrated by an analysis of his significant if also largely unrecognized influence on Albert Einstein. Einstein's first acquaintance with Duhem's La Théorie physique, son objet et sa structure around 1909 is strongly suggested by his close personal and professional relationship with Duhem's German translator, Friedrich Adler. The central role of a Duhemian holistic, underdeterminationist variety of conventionalism in Einstein's thought is examined at length, with special emphasis on Einstein's deployment (...) of Duhemian arguments in his debates with neo-Kantian interpreters of relativity and in his critique of the empiricist doctrines of theory testing advanced by Schlick, Reichenbach, and Carnap. Most striking is Einstein's 1949 criticism of the verificationist conception of meaning from a holistic point of view, anticipating by two years the rather similar, but more famous criticism advanced independently by Quine in Two Dogmas of Empiricism. In ‘Induction and Natural Kinds’, I proposed a solution to the problem of induction according to which our use of inductive inference is reliable because it is grounded in the natural kind structure of the world. When we infer that unobserved members of a kind will have the same properties as observed members of the kind, we are right because all members of the kind possess the same essential properties. The claim that the existence of natural kinds is what grounds (...) reliable use of induction is based on an inference to the best explanation of the success of our inductive practices. As such, the argument for the existence of natural kinds employs a form of ampliative inference. But induction is likewise a form of ampliative inference. Given both of these facts, my account of the reliability of induction is subject to the objection that it provides a circular justification of induction, since it employs an ampliative inference to justify an ampliative inference. In this paper, I respond to the objection of circularity by arguing that what justifies induction is not the inference to the best explanation of its reliability. The ground of induction is the natural kinds themselves. (shrink)

Ripstein's lectures, which constitute the central texts of this book, focus on the two bodies of rules governing war: the jus ad bellum, which regulates resort to armed force, and the jus in bello, which sets forth rules governing the conduct of armed force and applies equally to all parties. The lectures argue that both sets of rules constitute prohibitions rather than permissions, and that recognizing them as distinctive prohibitions can reconcile the seeming tension between them. By understanding that the (...) central wrong of war is that war is the condition which force decides, Ripstein contends that the law and morality of war are in fact aligned; the rules governing the conduct of hostilities must apply equally to parties in the right and parties in the wrong in an armed conflict, because the prohibitions outlined in the rules governing war are prohibitions that restrain war. Ripstein's method of analysis and the substantive argument he puts forward offer an opportunity for rigorous critical engagement in subsequent essays by commentators Hathaway, Kutz, and McMahan, followed by a response from Ripstein. A recent study by Olivieri et al, published in PLOS ONE, reports that between 2009 and 2015 a third of patients with thalassaemia in Canada’s largest hospital were switched from first-line licensed drugs to regimens of deferiprone, an unlicensed drug of unproven safety and efficacy. Based on retrospective data from patient records, the PLOS Study reports that patients treated with deferiprone, either as monotherapy or in combination with first-line drugs, suffered serious adverse effects. The data reported by Olivieri et al (...) give rise to a number of ethical issues. These ethical issues are identified, placed in historical context and analysed. For purposes of this analysis, reliance is placed on two core principles of research ethics, harm minimisation and informed consent, and also on the hospital’s mission statement. Then a mystery is explored: How and why did it happen that Toronto’s University Health Network treated large numbers of patients with an unlicensed drug over a period of many years? ‘Institutional conflict of interest’ is considered as a possible explanatory hypothesis. The ability to find relevant materials in large document collections is a fundamental component of legal research. The emergence of large machine-readable collections of legal materials has stimulated research aimed at improving the quality of the tools used to access these collections. Important research has been conducted within the traditional information retrieval, the artificial intelligence, and the legal communities with varying degrees of interaction between these groups. The problem of the ‘Unity of the Proposition’ is the problem of explaining the difference between a content-expressing declarative sentence and a ‘mere list’ of referents. The prevailing view is that such a problem is to be solved metaphysically, either by reducing our ontology to exclude propositions or universals, or by explaining how it is possible for a certain kind of complex entity – the ‘proposition’– to ‘unify’ its constituents. I argue that these metaphysical approaches cannot succeed; instead the only (...) viable approach is linguistic, identifying features of the (type–) sentence itself that enable it to express a content. Thus the problem of the ‘Unity of the Proposition’ (distinguishing sentences from lists) is distinct from the problem of ‘propositional unity’ (explaining how the constituents of propositions form a unified content). I suggest that, while the latter problem is not pressing, the former does not permit of an answer which applies in generality in all languages; we can only fully explain the Unity of the Proposition for single languages or groups of similar languages. Discussion at the symposium, and subsequent correspondence with participants, have raised a series of critical questions that seem to me to merit discussion. The issues raised have also led me to consider further some of the literature commenting on Newton’s work and on related matters in the history of optics. What was initially intended as a brief supplement to the foregoing paper [On Metaphysics and Method in Newton, item 10631] has thus evolved into a new article of considerable length.

A review of the philosophical debate on theoretical models for the physician-patient relationship over the past fifteen years may point to some of the more productive questions for future research. Contractual models have been criticized for promoting a legalistic and minimalistic image of the relationship, such that another form of model (such as convenant) is required. Shifting from a contractual to a contractarian model (in keeping with Rawls' notion of an original position) provides an adequate response to many criticisms of (...) this type. A deeper criticism, however, is one that advocates a shift to a virtue-based approach. A creative amalgam between a contractarian model and elements of the virtue-based approach, combined with appropriate empirical investigation, may yield richer models in the future. (shrink)

How one thinks about the relationship between individual autonomy (sometimes referred to as individual willpower or human agency) and technology can influence the way legal thinkers develop policy at the intersection of law and technology. Perspectives that fall toward the `machines control us' end of the spectrum may support more interventionist legal policies while those who identify more closely with the `we are in charge of machines' position may refuse to interfere with technological developments. The concept of soft determinism charts (...) a middle-ground between these two positions and could assist in the formulation of a general theory of the relationship between law and technology. Soft determinism maintains that technological developments are embedded in social, political, economic and other processes, and serve to guide and, potentially, configure future actions and relationships with these technologies, their users, and their subjects: while past technology develops shape the present, individuals and groups can still exert control over these technological developments. This essay examines neoconservative criticisms of equity planning, and the challenges against the right of government to regulate local development and land use. The specific concern of this essay is how, or if, local development administrators (equity planners), should use their discretionary powers to ensure that city officials and private developers promote and protect the interests of urban residents, particularly the poor and disadvantaged. The essay begins by discussing the alleged conflict said to exist between needy urban residents and the (...) more secure urban taxpayers. The contrary views of equity planners are then reviewed, and the tensions within the neoconservative arguments are exposed and critiqued. Finally, the dispute between equity planners and neoconservatives is further explored by examining the dispute over the voucher system to address the problem of equal educational opportunity in urban communities.
